1. INTRODUCTION

StellarAlgo Corp. (the “Company”, “we“, “us“, “our“) is committed to protecting your privacy. The following Privacy Policy describes how We collect, store, use and distribute personal information through our website, software application, and services.

Our goal is to collect, use and disclose only that personal information reasonably required to enable us to provide the particular product or service that you have requested, to maintain our customer/visitor lists and/or to respond to your inquiries or feedback and for other purposes further described in this Policy. If you have provided us with contact information, we will maintain the confidentiality of your contact information and use it only for the purposes for which we have collected it, unless you agree that we may disclose it to other third parties (subject to the exclusions we have listed below).

By using the Company websites, available at www.StellarAlgo.com and app.stellaralgo.com, including all subpages, (the collectively, “Websites”) and/or the Company Application and Services further described in our Terms of Service (the “Services“), you consent to the collection and use by us of Personal Information as described in this privacy policy.

2. SCOPE

This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals (“Personal Information”), particularly those individuals who use our Services (“Users”) on behalf of our clients (“Clients”), as well as our Clients’ end users, such as employees and customers (“End Users”).

This Privacy Policy does not apply to the practices of companies that we do not own or control, such as our Clients or other third-party organizations with which you choose to share Personal Information. You should review the applicable privacy policy of any company with which you do business. We do not knowingly collect or solicit Personal Information from anyone under the age of 13.

3. COLLECTION AND USE OF  PERSONAL INFORMATION AND OTHER DATA

3.1  Application Users

In order to use certain aspects of the Services, representatives of our Clients may be required to have a valid StellarAlgo account to log in to the Services (“Account”). We may collect the following type of Personal Information to set up and provide access to the Account: name and email address.

3.2  Prospective Clients and Business Partners

The Company also collects certain Personal Information about prospective clients, including name, company, role/position, email address(s), phone number, company address. This Personal Information is used to confirm the identity and authorization of the person requesting our services on behalf of the prospect or current client, as well as to communicate with the company in respect of the application and Services.

3.3  Customers and End User of our Clients

The Company processes Personal Information related to End Users and customers of our Clients on behalf of our Clients and in accordance with contracts between the Company and the Client.

As an analytics services provider, the Company collects data, including Personal Information, directly from our Clients about their customers, prospective customers and End Users in order to provide insights to our Clients. The Personal Information may include: name, address, city
State/province, country, postal/zip code, email, gender, date of birth, marital status, preferred salutation, ethnicity, religion, income, family status, language preference and/or occupation. In addition, we may collect purchase or transaction history related to the end user’s use of the Client services.

Generally, Personal Information is collected directly from our Clients who collect this Personal information in the course of providing their services. However, in some cases we may obtain Personal Information from other third-party databases made available to our Client or us.

The specific types of Personal Information collected will depend on the Client’s practices and business needs. You should contact your organization directly if you have any questions regarding their privacy practices.

3.4 Use of Personal Information

We use Personal Information for the purposes described above and generally for in the following ways:

  • To provide Services to our Clients. For example, the Company may analyze such data to advise Clients on marketing and end user engagement strategies;
  • To send to our Clients and prospective clients relevant information and updates related to the Services;
  • To generally understand the needs and interests of our Clients and their End Users;
  • To conduct anonymous analytics in order to improve and customize our Services and software application.
  • To support and troubleshoot the Services;
  • To investigate violations and enforce our policies, and as required by law, regulation or other governmental authority, or to comply with a subpoena or similar legal process or respond to a government request; and
  • To monitor system performance and network capacity, test and fix systems, and develop and implement upgrades to systems.

4. STORAGE LOCATION AND TRANSFER OF PERSONAL INFORMATION

The Company stores its data, including Personal Information, on servers located in Canada and the United States, including through the use of our third-party service providers. By submitting information, you agree to this transfer, storing or processing of your Personal Information in Canada or the U.S. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in Canada or the U.S. under lawful access regimes or court order.

5. DISCLOSURE OF PERSONAL INFORMATION WITH THIRD PARTIES

5.1  Disclosure of Results to Clients

Personal Information collected or generated on behalf of our Clients will be shared with those Clients. In particular, the Company may receive email addresses of Client’s End Users and use these email addresses to create marketing campaigns on behalf of the Client, including online and social media campaigns (e.g. Facebook audiences, Google audiences, marketing automation lists). Any additional Personal Information collected about the End Users on behalf of our Client, will be disclosed to the Client. In this capacity, we are acting as a service provider of the Client and using Personal Information of End Users in accordance with the Client’s instructions and the Client’s privacy policy.

5.2  Disclosure of Statistical Data

The Company discloses aggregate statistical data to its partners and clients, such as advertisers and other third parties, who may use the data for business purposes. This information does not include any Personal Information or otherwise identify any individual Users or End Users.

5.3  Service Providers and Business Partners

We may from time to time employ other companies and people to perform tasks on our behalf and need to share Personal Information with them to provide the Application Services. Unless we tell you differently, such third parties do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. This includes third-party companies and individuals employed by us to facilitate our Services. In particular, the Company uses Amazon Web Services, Hubspot (CRM) and Microsoft 360 to support its Application Services.

5.4  Business Transfers

If we (or substantially all of our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information  may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law.

5.5  With Your Consent

If we need to use or disclose any Personal Information in a way not identified in this Privacy Policy, we will notify you and/or obtain your express consent as required under applicable privacy laws.

6. COOKIES

Technologies such as cookies, scripts and tags are used by us and our third party partners. These technologies are used in analyzing trends, administering the Website, tracking users’ movements around the Website, and gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis. Various browsers may offer their own management tools for removing these types of tracking technologies.

Standing alone, cookies do not identify you personally. They merely recognize your browser. Cookies come in two types: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you’ve closed your browser or turned off your computer. They include information such as a unique identifier for your browser.

The Company uses session cookies containing encrypted information to allow the system to uniquely identify you while you are logged in. This information allows The Company to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you’ve logged in and are required in order to use the Company Services.

The Company uses persistent cookies, that only The Company can read and use, to identify the fact that you are a The Company user and track the webpages you view and use. We are especially careful about the security and confidentiality of the information stored in persistent cookies. Users who disable their web browser’s ability to accept cookies will be able to browse our Website but may not be able to use all features of our Company Services.

Our third party partners also employ clear gifs, images, and scripts that help them better manage content on our site.

7. SECURITY

The security of your Personal Information is important to us.  We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment.  We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us.  We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you.

8. RETENTION

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you.

You can request that the Company delete your Personal Information at any time. However, we may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy.

9. ACCESS, CORRECTION AND ACCURACY

You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information.  Upon receipt of your written request, we will provide you with a copy of your Personal Information, although in certain limited circumstances, and as permitted under law, we may not be able to make all relevant information available to you, such as where that information also pertains to another user.  In such circumstances we will provide reasons for the denial to you upon request.  We will endeavor to deal with all requests for access and modifications in a timely manner.

We will make every reasonable effort to keep your Personal Information accurate and up to date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate.  As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information.  Having accurate Personal Information about you enables us to give you the best possible service.

10. CHANGES TO THIS POLICY

We may amend this Policy from time to time. Use of Personal Information we collect is subject to the Policy in effect at the time such information is collected, used or disclosed. If we make material changes or changes in the way we use Personal Information, we will notify you by posting an announcement on our App or Services or sending you an email prior to the change becoming effective. You are bound by any changes to the Policy when you use the App after such changes have been first posted.
